These Terms of Use ("Terms") govern your access to and use of the Hobii mobile application and related services (the "Service"), operated by Fiona Sykes ("we", "us", "our"). Please read these Terms carefully before using Hobii.
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use Hobii. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
You may create an account using your email address, Google account, or Apple ID. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at sykes6355@gmail.com if you suspect unauthorised access to your account.
You may not create accounts for others without their permission, use another person's account, or create multiple accounts for abusive purposes.
Subscription: Hobii offers a monthly subscription at £/$ 7.99 per month (the "Premium Plan") which unlocks full access to the Service's features. Pricing may vary by region and is displayed in the app at the time of purchase.
Billing: Subscriptions are billed through Apple In-App Purchase or Stripe, depending on your platform. Payment is charged to your payment method upon confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access until then. We do not offer refunds for partial billing periods except as required by applicable law.
Free trial: If we offer a free trial, it will convert to a paid subscription at the end of the trial period unless cancelled before the trial ends.
Price changes: We may change subscription pricing by giving you reasonable notice. Continued use after a price change constitutes acceptance of the new price.
The Service allows you to upload, post, and share content including patterns (PDF files), videos, photos, and text ("User Content").
Your ownership: You retain all ownership rights in your User Content.
Licence to us: By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, reproduce, and distribute your User Content within the Service for the purpose of operating and improving Hobii. This licence ends when you delete the content or close your account.
Your responsibility: You are solely responsible for your User Content. By posting content, you represent that:

Hobii allows users to create and join clubs (hobby groups). Club creators are responsible for moderating their club content in accordance with these Terms. We reserve the right to remove any club, content, or user that violates these Terms.
The Hobii name, logo, app design, and all content we create (excluding User Content) are owned by Fiona Sykes and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our written permission.
Our Privacy Policy describes how we collect and use your personal information. By using the Service, you agree to our Privacy Policy.
The Service integrates with third-party services including Google, Apple, Stripe, and Supabase. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIONA SYKES AND HOBII SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Fiona Sykes and Hobii from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws in your jurisdiction provide otherwise.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by in-app notification. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
